Stop NorthPoint Intends to File TRO, Amended Complaint

Attorneys for Stop NorthPoint LLC announced in court today the group’s intent to seek a temporary restraining order in an effort to prevent the City of Joliet from moving forward with the NorthPoint annexation hearings.

“We are trying to enjoin any hearings or meetings from occurring on December 3 or December 10,” said Richard Linden, of Linden & Bustamante, one of Stop NorthPoint LLC’s attorneys, which also include Bob Fioretti and Peter Bustamante.

This delay does not change Stop NorthPoint’s primary goal of seeking a permanent halt to the project.

Stop NorthPoint had previously filed a five-point complaint seeking a permanent injunction against the City of Joliet and NorthPoint Development. Tuesday’s hearing before Judge John Anderson was for the defendants’ motion requesting additional time to respond to Stop NorthPoint’s complaint.

Anderson recused himself from the case citing that he has close family members who oppose the project. The presiding judge re-assigned the case to Associate Judge Ted Jarz.

Stop NorthPoint also announced it’s intent to file an amended complaint to add more counts and additional plaintiffs.

“Given what has transpired since the original filing there have been a series of events that we are asking a court to evaluate,” said Erin Gallagher, volunteer spokesperson for Stop NorthPoint.

The next hearing on these matters is tentatively set for December 2 via Zoom at 9:30 am.

Stop NorthPoint LLC plaintiffs include numerous decorated veterans, many of whom live in Joliet, as well as others living throughout Will County. The legal initiative is funded by numerous individuals and businesses whose average contribution is $75-$125. Stop NorthPoint founders, managers and spokesperson are working at 100 percent volunteer capacity.
